4. AI SERVICES & AUTOMATED COMMUNICATION DISCLOSURE

By using our Services, you acknowledge:

  • You may be interacting with an AI-powered system, not a human
  • AI Agents may record, analyze, store, and process communications
  • AI outputs may not always be accurate, complete, or error-free
  • You are responsible for reviewing AI-generated content before using it

You agree not to rely solely on AI outputs for:

  • Legal decisions
  • Medical advice
  • Financial decisions
  • Any high-risk or regulated activity

You are responsible for compliance with:

  • TCPA (Telephone Consumer Protection Act)
  • CAN-SPAM
  • GDPR
  • CCPA
  • Any applicable industry regulations

We are not liable for decisions made based on AI-generated outputs.

5. USER & CLIENT RESPONSIBILITIES

You agree to:

  • Provide accurate and up-to-date information
  • Supply necessary training data (scripts, FAQs, business details)
  • Monitor AI outputs for accuracy and compliance
  • Use Services only for lawful purposes

You may NOT:

  • Misuse or interfere with Services
  • Reverse engineer or copy our systems
  • Attempt unauthorized access
  • Use AI to impersonate others or misrepresent identity
  • Use Services for spam, harassment, or illegal outreach

6. SMS / COMMUNICATION TERMS

By providing your phone number and opting in:

  • You consent to receive SMS messages from us
  • Message frequency may vary
  • Message and data rates may apply

7. FEES, SUBSCRIPTIONS & BILLING

  • Fees are non-refundable unless otherwise stated in writing

Failure to pay may result in suspension or termination of Services.

8. INTELLECTUAL PROPERTY

All content and technology are owned by Pacific Marketers, LLC, including:

  • The Chatbot Studio brand and assets
  • AI systems and workflows
  • Software, scripts, and automation systems

You may not:

  • Copy
  • Modify
  • Distribute
  • Resell
  • Reverse engineer

without written permission.

9. NO GUARANTEE OF RESULTS

We do not guarantee:

  • Sales or revenue increases
  • Lead generation results
  • Search engine rankings
  • Performance of third-party platforms

Results depend on many factors outside our control.

10. THIRD-PARTY SERVICES

We may integrate with:

  • CRM platforms
  • Telephony providers
  • Payment processors
  • AI systems
  • Hosting providers

We are not responsible for:

  • Downtime
  • Errors
  • Policies
  • Security

of third-party services.

11. DISCLAIMER OF WARRANTIES

All Services are provided:

We make no guarantees regarding:

  • Reliability

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

The Chatbot Studio and Pacific Marketers, LLC shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • AI-generated errors or misinterpretations
  • Service interruptions or downtime

Liability Cap

Our total liability shall not exceed the amount paid by you in the 30 days prior to the claim.

13. INDEMNIFICATION

You agree to indemnify and hold harmless:

  • The Chatbot Studio
  • Pacific Marketers, LLC
  • Its employees, contractors, and affiliates

from any claims arising from:

  • Your use or misuse of the Services
  • AI-generated communications used by you
  • Violations of laws or regulations
  • Breach of these Terms

14. TERMINATION

We may suspend or terminate Services at any time for:

  • Non-payment
  • Violations of these Terms
  • Unlawful or abusive use
  • Risk to systems or reputation

16. GOVERNING LAW & DISPUTE RESOLUTION

Any disputes shall be resolved through binding arbitration in Wyoming or California, unless otherwise agreed in writing.

Continued use of the Services constitutes acceptance of any updates.
